An amazing start for Éric Dupond-Moretti, who had never set foot on this ground before. The Minister of Justice announced this Tuesday morning from the agricultural fair that he wanted to defend a bill to avoid “false trials” of farmers in case of noise or auditory pollution.

“The Parisian who has just settled near a farm is a bucolic dream that, for him, becomes a nightmare when he hears the rooster crow,” joked the Keeper of the Seals during a conference at the stand of the majority agricultural union, the FNSEA , in the Hall of agriculture.

“We shouldn’t bother people who work”

In the viewer of the former lawyer, cases that have made headlines in recent years, a case in Ariège where the owners of a rooster had to deal with the repeated complaints of one of their neighbors, who could no longer stand the song of the animal . to the Aude cows whose bells annoyed the neighbors.

Highly publicized, these neighborhood fights can even turn tragic for rural dwellers. In the Ardèche, a rooster was killed in May 2020 by a neighbor who found it too noisy. The man has since received a 5-month suspended prison sentence.

“The agricultural world, yes, there is noise, people who get up in the morning, leave with the tractor, and who prohibit others from sleeping. (…) I say it in a humorous tone but that generates many lawsuits. those things and you don’t have to piss off the people who work,” continued the former lawyer.

A proposal very close to an existing law

The bill has never been mentioned by Éric Dupont-Moretti before and appears to duplicate an existing legal provision. The sounds and smells of the French countryside can no longer be the reason for a complaint for “abnormal neighborhood disturbances” from January 2021 and the adoption by Parliament of the notion of “sensory heritage” of the French countryside.

According to the Minister of Justice, it is planned to “give a hand” to farmers through a bill “on civil liability” that will be presented shortly.
