Justice Minister assures she will reconsider alternative ways of conflict management

Justice Minister Catarina Sarmento e Castro assured Wednesday that the government will “reconsider alternative ways of conflict management” when asked about the arbitration of disputes between the state and private parties.

Speaking to journalists, the PS executive’s governor assured after a visit to Ponta Delgada prison in the Azores that the ministry “will look into arbitration issues” regarding the position of the Association of Portuguese Judges (ASJP). who challenged the government to legislate on the arbitration of disputes between the state and the private sector.

“We are going to look at the issues of arbitration. We are going to look at the issues of alternative remedies in general. (…) We are going to rethink the alternative remedies of conflict management. That is what we are doing,” he said without further ado. to work.

Catarina Sarmento e Castro gave the example of the justices of the peace as an “alternative means of process”, through which “justice can reach more people”.

“The justices of the peace are alternative means of proceedings that make it possible to quickly resolve cases of up to five thousand euros, relatively simple cases and at very low costs. With alternative means of proceedings it is possible to bring justice to more people”, emphasizes.

On Tuesday, the ASJP challenged the justice minister to enact legislation on the arbitration of disputes between the state and private parties and warned that if the government refuses to act, it will make proposals on the matter.

Speaking to the Lusa agency, the association’s president, Manuel Soares, revealed that he had already discussed the matter twice with the Minister of Justice, Catarina Sarmento e Castro, as he believed there had been immorality in the ‘ad hoc’ arbitration courts specially set up to settle disputes between the public and private sectors, often involving millions of euros in public money, without the necessary scrutiny.
