A liberal group filed a lawsuit in Michigan on Friday alleging that former US President Donald Trump is disqualified from running for president based on a rarely used provision of the post-Civil War US Constitution.
It is the first time that an organization with significant legal resources has attempted to block the campaign of the Republican leader in a state with swing state status, which oscillates between Democrats and Republicans and is important in the final result of a presidential election.
The group Free Speech For People argued that Trump’s attempt to overturn his 2020 election loss and encouragement of the January 6, 2021 attack on the Capitol violated section three of the 14th Amendment, which states that anyone who swears an oath to defend the Constitution and was then “engaged in insurrection or rebellion” against that same Constitution is disqualified from holding public office.
This is the second time the organization has filed a lawsuit to block the Republican Party’s presidential candidacy, after the first in the state of Minnesota.
Dozens of cases have been filed nationwide, but the first filed by organizations with significant legal resources are those of the group Free Speech For People and one filed in Colorado by another liberal group.
Donald Trump, who appears in polls as the favorite candidate for the Republican Party primaries and who is criminally accused in four cases, is preparing for an unprecedented year 2024, with his electoral and judicial agendas intersecting.
The former president is accused in four criminal cases and three civil cases, and all of them could go to trial before the 2024 presidential elections, some of them as early as this year.
Trump considers these lawsuits to be a politically motivated attempt to prevent him from returning to the White Caste.
