The 2024 ecological penalty steps up its game without affecting the market-leading cars

The 2024 finance bill presents a particularly harsh scale of CO2 penalties, which can reach 60,000 euros. The impact remains limited in the most popular models, Bercy says.

A particularly harsh penalty: this is the observation we can make when discovering the new network for 2024, revealed in the finance law (PLF).

This surcharge, which affects new models that emit more CO2, will now be applied from 118 g/km, compared to 123 g/km in 2023 (see comparison table below).

An increased and unlimited penalty: ciao the Mustang

The quantities are reinforced especially for vehicles that emit more CO2. The ceiling of grief for those who broadcast more than 193 g/km is now set to 60,000 euros, while in 2023 it would cost “only” 50,000 euros starting at 226 g/km.

Above all, the maximum fine limit of 50% of the purchase price is eliminated, “which specifically benefits very expensive and highly polluting vehicles,” according to Bercy. Until now, the surcharge could not exceed half the purchase value of a model.

Example: a 58,400 euro Ford Mustang emits at least 256 g/km. In 2023, his penalty was thus limited to half the amount of this purchase, that is, 29,200 euros (and not the 50,000 euros of the maximum penalty limit). Therefore, in 2024, the penalty will definitively put an end to this type of sports vehicle, with a penalty that now exceeds the purchase price.

A massive penalty starting at 1.6 tons and progressive

The weight penalty, now called the “mass penalty” (or “operating mass tax”) is now applied in 1.6 tons, compared to 1.8 tons until now. Implemented since January 1, 2022, it had not changed much in 2023 and applied 10 euros per kilogram above 1,800 kg. With a cumulative limit with the CO2 penalty that could not exceed 50,000 euros.

HE the scale becomes progressive: for a vehicle with a mass of 1600 kg, per kilo costs 10 euros. From 1,800 kg we go to 15 euros per kg, from 1,900 to 20 euros per kg, from 2 tons to 25 euros per kg and, finally, from 2,100 kg, 30 euros per kg.

As expected, and if 100% electric vehicles remain exempt from this mass penalty, this will no longer be the case for plug-in hybrids, but only from January 1, 2025. The latter will continue to be entitled to a tolerance that reflects the weight of the Battery: if its autonomy exceeds 50 km, it will be possible to subtract 200 kg from the mass in operation within the limit of 15% of this same mass.

Example: in a 1.9 ton plug-in hybrid vehicle, we can eliminate 200 kg and go down to 1.7 tons, i.e. 1,000 euros mass penalty instead of 3,495 euros (10 euros per kg from 1,600 to 1,799 kg, that is, 1,990 euros + 15 euros per kg from 1800 to 1899 kg, or 1485 euros + 20 euros for 1900 kg).

A supervised reimbursement for “large families”

However, it is advisable to maintain a reduction in the CO2 and weight penalty so as not to penalize families: in 2023, with 3 children or more, 20 g/km and 200 kg per child can be eliminated.

On the other hand, this refund called “large family” can only be requested once in a period of two years. Enough to put an end to the abuses suspected by Bercy, to “put an end to certain abuses detected during reimbursement requests followed by the immediate transfer of the vehicle or at very short intervals”, notes the PLF.

Popular models were saved

Bercy also mentions “a limited impact on the five best-selling vehicles in France” which will not be affected by the increase in the weight penalty and only by an increase in the CO2 penalty “of 50 or 100 euros per vehicle.” In fact, a little more if we look, for example, at number one in sales in France since the beginning of the year.

At the top of the new vehicle sales ranking, the Renault Clio is affected by its gasoline engines such as the TCe 90, which emits between 118 and 120 g/km, with a penalty ranging from 0 to 50 or 100 euros . In the SCe 65 (which the Dacia Sandero also equips), between 120 and 121 g/km, we go from 0 to 100 or 125 euros.

In a Peugeot 2008 PureTech 100 petrol, the only SUV in the top 5, we also noticed an increase of 120 euros, with a penalty that goes from 50 to 170 euros for 123 g/km.

TVS catches up with plug-in hybrids

Another notable fact in this PLF, the reinforcement of the tax on company vehicles (TVS) with a trigger starting at 5 g/km of CO2, compared to 20 g/km until now. Direct consequence: plug-in hybrids will no longer escape, with the last exception of 100% electric ones.

Finally, vans with four or more seats (compared to the current five or more seats) and “off-road trucks” should no longer be able to escape the penalty.
