Burned premises, broken glass, looted goods… In recent days, dozens of shops and restaurants have been looted by the rioters, but also bank branches, supermarkets, pharmacies, tobacconists, car dealerships or hairdressing salons. Given the extent of the damage, some businesses will not be able to reopen for several days or even weeks.
In this situation, employees who are unable to work may be placed on partial duty by their employer. If we remember it especially for the health crisis, or more recently for the automobile industry in the face of the chronic shortage of electronic components, partial activity within a company is authorized for any “exceptional circumstances” – significant damage linked to the disturbances , in the present case.
60% of gross salary
If you decide to put your workers on partial unemployment, the employer is obliged to pay them compensation corresponding to 60% of the gross salary for each hour not worked, which represents approximately 72% of the hourly net salary. However, this compensation cannot be less than 9.12 euros per hour not worked, that is, the equivalent of the hourly minimum wage, and cannot exceed the maximum limit of 31.10 euros, that is, 60% 4, 5 of the minimum gross hourly wage.
To receive compensation, seniority is not necessary, nor is it any condition related to the type of contract (CDI, CDD, temporary workers, apprentices) or work time (full-time, part-time). The employer, in return, receives an allowance if requested, paid by the State through the Services and Payments Agency (ASP). It amounts to 36% of the worker’s gross salary for each hour not worked, with a floor of 8.21 euros and a ceiling of 18.66 euros.
