Visapress says there is no copyright infringement in the Ventura fake news case

The Executive Director of Visapress, in statements to Lusa, believes that there is no copyright infringement in the case of the false news that André Ventura targeted Renascença and Público.

At issue is the fact that Folha Nacional, Chega’s communications body, and its leader, André Ventura, spread false news using images similar to those published by Renascença and Público earlier this month.

Visapress’ executive director, Carlos Eugénio, emphasizes that “for something to be copyrighted, it must have formed the author’s creation. That is, it must have something unique that was made by a human being.”

Well, “the graphics and the way it was used, [numa] Attempting to stick with the media without ever using their logo is something anyone can do and is unlikely to be protected,” neither by copyright nor industrial property, he adds.

In this case, “a combination of colors and a font was used, so anybody can do this,” says the person in charge, noting that “there’s an added responsibility here when it comes to a media agency [Folha Nacional] of at least complying with the deontological rules of journalism”.

However, he reads that it is very difficult to accuse André Ventura of copyright infringement.

“What has been done is very similar to the publications [Público e Renascença]but the names of the publications are never placed there,” he emphasizes.

Therefore, “in my humble opinion there is no violation of rights here, the only right that could be violated here is industrial property, but if it is not registered, that kind of creation is not guaranteed, there is nothing to do,” he insists.

Visapres is a private law non-profit organization that performs the collective management of copyrights, owners and other copyright holders with respect to all works or journalistic content published in newspapers and magazines, regardless of the medium or support used.

Meanwhile, this topic is being investigated by the Public Prosecutor’s Office (PGR), which confirmed on August 21 that it was investigating the spread of false news by the leader of Chega on social networks, using images similar to those of the media.

On the same day, when questioned on the subject at a press conference, Chega’s president defended that the party acted “within the law” regarding the allegation of disclosing misinformation on its social networks, rejecting that any “unlawful act” had been committed. concerned.

“We are absolutely aware that we acted within the law and that we have the law on our side. We will confidently await the ERC’s decision on this matter,” defended André Ventura, reiterating: “We will wait for the ERC to make a decision, when the ERC makes a decision, we will be here to to comment on it. What our lawyers tell us at the moment is that we are perfectly protected within the law, that Chega has not committed any illegal act.”

Ventura rejected that it was fake news, stating that “they were from Folha Nacional”, the party’s newspaper, and made by Chega associates and leaders.

Some of the images published by Ventura are signed “redação”, while on the website of the party newspaper they usually have the designation “Folha Nacional” in the signature, and none of these publications have an associated link to the original article.

As for the publication entitled “Thousands of WYD subscribers are missing. Illegal immigration, specialist says”, which appeared on André Ventura’s page with images similar to those from the Renaissance: it does not appear on that radio’s website and nor is it possible to find it in a general web search.
